    Court proceeding halted after attempted murder accused faints before sentencing

    The accused being stretchered to an ambulance at the court complex after he fainted prior to sentencing.

    KUCHING (June 9): An unemployed man who pleaded guilty to attempting to murder a police officer, among other offences, fainted in the dock at the Magistrate’s Court here yesterday.

    Mizi Mohamad, 24, collapsed in front of Magistrate Syarifah Fatimah Azura Wan Ali moments before sentencing, causing the proceeding to be come to a halt.

    The accused was said to be in weak condition due to injuries on both legs as a result of being shot by police in an incident at Jalan Bako here on May 31.

    The court fixed June 16 for sentencing and allowed the accused, who was taken to Sarawak General Hospital for further treatment, to be released on court bail of RM10,000 with one local surety.

    Mizi, who was unrepresented, pleaded guilty to a charge under Section 307(1) of the Penal Code, to attempting to kill ASP Mohd Fauzi Mohammat by swinging a machete at the police officer who was less than a metre away from him.

    He also pleaded guilty to a charge under Section 427 of the Penal Code for damaging a police patrol vehicle which resulted in a loss of RM3,000.

    Both offences were committed at around 12.30pm near Jalan Bako here on May 31.

    The accused also pleaded guilty to a third charge, framed under Section 506 of the Penal Code, for threatening to injure his father at their home in Kampung Hijrah, Jalan Bako here at around 9am on May 31.

    According to the facts of the case, the police received a call at 11.23am that day from members of the public, informing that that an individual armed with a machete had run amok at his house and had threatened to kill a family member.

    Police personnel led by a senior officer were dispatched to the scene in two patrol cars where upon their arrival, they saw the accused attempting to attack his neighbours and immediately tried to calm him down.

    However, he responded by charging at them and swinging the machete at the police officer, forcing police to open fire at his legs.

    Following the incident, the accused was sent to the hospital for treatment where he was reported to be in stable condition.

    The prosecution was handled by Inspector Mohd Adzmei Ahmad.
